McKinney Vento

McKinney-Vento Homeless Education Assistance Act and Texas state law protects the rights for homeless, children and youth, to receive a free and appropriate public education. Students experiencing homelessness are eligible for the protections and services the Mckinney-Vento Act provides to increase educational stability and remove barriers to school enrollment. It was reauthorized as Title I, Part A, of the Every Student Succeeds Act (ESSA) in 2015. Children and youth between the ages of 5 to 21, on September 1st of the current school year, could qualify for federally funded services if one of the following is met:

  • share housing with family or friends due to loss of housing, economic hardship, or a similar reason;
  • living in a motel, hotel, RV park, or camping ground due to the lack of alternative adequate accommodations;
  • living in emergency or a transitional shelter;
  • abandoned in hospital;
  • awaiting foster placement;
  • have a primary nighttime residence that is a public or private place not designed for or ordinarily used as a regular sleeping accommodation for human beings;
  • living in a car, park, public space, abandoned building, substandard housing, bus or train station, or similar settings; or
  • migratory children living in the circumstances previously described.

The enrollment process in Alvarado ISD includes a "Student Residency Questionnaire" (SRQ) as part of our comprehensive efforts to identify children and families currently experiencing homelessness. The educational rights homeless children and youth have under the McKinney-Vento Act include; the right to go to school, enroll in school without giving a permanent address, continue attending the school they were enrolled in before the homelessness occurred when feasible, or enroll in the Texas public school district of their choice with the campus designation being determined by the school district.
